Damages and the Human Toll

 

The damages sought are staggering. A breakdown shows over $121,000 in actual damages per plaintiff, alongside $81,000 in compensatory damages for humiliation, mental anguish, and emotional distress .

  • Constructive Eviction: Moving/storage costs, new housing fees, emotional distress.
  • Unfair & Deceptive Trade Practices (UDTPA): Trebled damages possible, reaching nearly $30,000 per claim.
  • Negligence Per Se (multiple statutes): Applied to Fair Housing violations, towing abuses, and NC real estate licensing failures.
  • Intentional Infliction of Emotional Distress: Claims rooted in medical harm from forced displacement during transfusion recovery.

 

Court documents also highlight that the veteran endured severe mental and physical harm — including cluster seizures and manic/depressive episodes — aggravated by housing insecurity and the hostile environment .
